The owner assures that the boat was inspected thoroughly and the motor is in great condition. It is the responsibility of the renter to inspect the boat for any damage or issues before taking it from the owner. If the renter wishes to extend, the renter should contact the owner to notify them that you want to extend the rental period. If the owner agrees, then the additional payment will be made after the extended rental period. The reservation can be canceled and refunded if the owner is notified at least 2 days prior to the rental period term. No refunds for cancellations are made within 24 hours of reservation, even if the rental session has been canceled. RECREATIONAL EQUIPMENT USE WAIVER AND RELEASE OF LIABILITY READ BEFORE BOOKING In consideration of being allowed to use any and all of the recreational and sports equipment, which includes, but is not limited to, fishing poles, tow ropes, flotation devices, boat, cooler, motorboat and other items on the marina and/or provided 1) Based on the understanding that there is no obligation on the part of the owner or any of its representatives or any other third parties to repair, service or otherwise maintain any components of the Equipment nor the totality thereof, I have undertaken a thorough inspection of the Equipment and I have satisfied myself as to the condition thereof and I find and accept such Equipment as being safe and reasonably suited for the purposes of my use; and,  2) The risk of injury from any and all activities involved in using the Equipment is significant, including the potential for permanent paralysis and death, and while a particular user’s caution, experience, and personal discipline may reduce this risk, the risk of serious injury, or death, does exist; and, 3) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE PROPERTY OWNER of the Property, its personal representatives, members, trustees, officers, officials, agents, heirs and assigns, their agents, or others, and assume full responsibility for my personal or authorized use of all such equipment or item; and, 4) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the property owners of any equipemrnt or boat or boating advice and their personal representatives, members, trustees, officers, officials, agents, heirs, assigns and/or employees (collectively, the “Releasees”) WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage of any kind whatsoever, to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. 5) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin,  HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE any and all of the Releasees from any and all liability for loss or damage, and any claim or demands therefor on account of injury to my person or property or resulting in my death, whether caused by the negligence of the Releasees or otherwise arising in connection with my use of the Equipment. 6) I understand that this RECREATIONAL EQUIPMENT USE WAIVER AND RELEASE OF LIABILITY (“Agreement”) is intended to be as broad and inclusive as permitted by the laws of the State of Hawaii and agree that if any portion is held invalid, the remainder of the waiver and release will continue in full legal force and effect. 7) I agree that by booking this boat I have viewed this agreement and agree to all provisions. 8) Once booked, in no event shall I rescind this signature for perpetuity. I HAVE READ THIS RECREATIONAL EQUIPMENT USE WAIVER AND RELEASE OF LIABILITY AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION) This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's use of any of the recreational equipment described herein, as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE to the fullest extent permitted by law.
